Fiduciary Representation -The Essence of True Agency. Traditionally, agency is a fiduciary relationship – one of complete trust in which an agent owes his principal (client) uncompromised loyalty, diligence, disclosure and financial accountability. As a fiduciary, an agent is legally obligated to place the interests of the client above the agent’s own, avoiding self-serving practices and all conflicts of interest. Georgia Does Not Require Fiduciary Representation. Georgia brokerage law imposes limited, non-fiduciary, representation standards that permit agents to engage in profitable self-serving practices at the expense of their clients. These include dual agency, steering clients, and receiving undisclosed compensation. Although they are free to adopt traditional agency standards, virtually all Atlanta real estate brokerages (other than Sage) operate under Georgia’s conflicted, non-fiduciary client representation standards.
